Participation in The Ignition Society’s activities, including but not limited to car meets, drives, rallies, adventures, and travel, involves inherently dangerous activities, including driving vehicles at high speeds, navigating challenging routes, or engaging in automotive-related events. These activities carry significant risks, including but not limited to personal injury, death, property damage, or emotional distress, whether caused by your actions, the actions of others, road conditions, weather, or other factors.
By participating, you acknowledge and voluntarily assume all risks associated with these activities.
You hereby waive, release, and discharge The Ignition Society, its officers, directors, employees, agents, sponsors, and affiliates from any and all claims, liabilities, or causes of action arising from your participation, including those resulting from our negligence, to the fullest extent permitted by law. You agree that we are not liable for any damages, losses, or injuries, and you participate at your own risk.

1. Membership Eligibility and Application
1.1 Eligibility: To become a member, you must be at least 18 years old (or the age of majority in your jurisdiction) and possess a valid driver’s license if participating in driving-related activities. Membership is open to individuals who share an interest in cars and automotive culture, subject to our sole and exclusive approval.
1.2 Application Process: Membership applications are submitted through our website or designated platforms. We reserve the right to accept or reject any application at our sole discretion, for any reason or no reason at all, without providing reasons.
1.3 Membership Types: We may offer various membership tiers (e.g., basic, premium), each with associated fees, benefits, and restrictions as described on our website.
1.4 Termination of Membership: We may terminate or suspend your membership at any time for any reason, including violation of these Terms, with or without notice. Upon termination, you must cease using all Services.
2. Fees and Payments

You must resolve any payment issues directly with the processor.
2.3 No Refunds: All payments, including event fees, are final and non-reimbursable, even if an event is canceled, postponed, or if you are unable to attend. In the rare case of a Society-initiated cancellation, we may offer credits toward future events at our discretion, but no cash refunds will be provided.
2.4 Automatic Renewal: If your membership involves recurring payments, it will automatically renew unless you cancel prior to the renewal date. You authorize us to charge your payment method on file.
3. Online Platform and User Conduct
3.1 Account Creation: To access online features, you must create an account with accurate information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
3.2 User Content: You may post, upload, or share content (e.g., text, photos, videos) on our online platform. You retain ownership of your content but grant us a worldwide, royalty-free, perpetual, irrevocable license to use, modify, distribute, and display it for Society purposes, including promotion.
3.3 Prohibited Conduct: You agree not to:
- Post illegal, harmful, abusive, defamatory, or infringing content.
- Harass, bully, or spam other members.
- Use the platform for commercial purposes without permission.
- Attempt to hack, disrupt, or interfere with the platform.
- Violate any laws or third-party rights.
3.4 Moderation: We reserve the right to monitor, remove, or edit any content and to suspend or ban users for violations at our sole discretion.
3.5 Intellectual Property: All Society content (e.g., logos, website design) is owned by us or our licensors. You may not use it without permission.

4. In-Person Events, Adventures, and Travel

Events may be canceled, postponed, or modified due to weather, logistics, low attendance, force majeure, or other reasons. Capacity may be limited, and participation is on a first-come, first-served basis or by selection.
4.3 Attendance Limits: Not all members may be able to attend all events due to space, safety, or other constraints. We are not obligated to provide alternatives or accommodations.
4.4 Your Responsibilities: You must comply with all event rules, laws, and safety guidelines. You are responsible for your own transportation, equipment, and preparations.
5. Media Release and Likeness
5.1 Consent to Recording: By participating in any Society activity, you consent to being photographed, filmed, or recorded ( “Media” ).
5.2 License Grant: You grant us an irrevocable, royalty-free, worldwide license to use, publish, distribute, and reproduce your likeness, voice, and any Media featuring you in any medium (e.g., website, social media, prints) for promotional, archival, or other Society purposes, without compensation or further consent.
5.3 No Revocation: This consent cannot be revoked and extends to any derivatives of the Media.
6. Disclaimers, Waivers, and Indemnity
6.1 Assumption of Risk: Participation in Society activities, both online and in-person, involves inherent risks, including but not limited to property damage, injury, illness, or death from driving, travel, physical activities, or interactions with others. You assume all such risks voluntarily.
6.2 Waiver of Warranties: The Services are provided “as is” without warranties of any kind, express or implied, including fitness for a particular purpose, safety, or non-infringement. We do not guarantee the accuracy, completeness, or availability of any content or events.
6.3 Limitation of Liability: To the fullest extent permitted by law, The Ignition Society, its officers, directors, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Services, even if advised of the possibility. Our total liability shall not exceed the fees paid by you in the prior 12 months.
6.4 Indemnification: You agree to indemnify, defend, and hold harmless The Ignition Society and its affiliates from any claims, losses, damages, or expenses (including legal fees) arising from your violation of these Terms, your participation in activities, or your user content.
6.5 Release: You release The Ignition Society from any claims related to injuries, losses, or damages incurred during events or use of the Services.
6.6 Force Majeure: We are not liable for failures due to events beyond our control, such as natural disasters, pandemics, or government actions.
7. Intellectual Property and Trademarks
7.1 Ownership: “The Ignition Society” and related marks are our trademarks. You may not use them without written permission.

8. Governing Law and Dispute Resolution
8.1 Governing Law: These Terms are governed by, and under the jurisdiction of, the laws of San Mateo County, California, without regard to conflict of laws principles.
8.2 Arbitration: Any disputes shall be resolved through binding arbitration in San Mateo County, per the rules of the American Arbitration Association. You waive the right to class actions or jury trials.
8.3 Severability: If any provision is invalid, the remainder remains in effect.
